Gibraltar is a British Overseas Territory at the southernmost tip of the Iberian Peninsula. It covers a land area of 6.5 sq. km and the population is about 28,000. There is no special regime for offshore companies and the company used by non-residents for international activities is the non-resident company. To qualify as non-resident the company has to satisfy the following conditions:
- It must be owned by persons who are not resident in Gibraltar
- It must be managed and controlled by persons who are not resident in Gibraltar
- It may not trade or carry on business in Gibraltar with persons who are resident in Gibraltar
- There must be a Gibraltar resident Secretary and it must keep its Company Register in Gibraltar
- It must not remit income to Gibraltar
Taxation
Providing the above conditions are met a Gibraltar non-resident company is not taxable in Gibraltar.
